Brisbane is a community property state, which means that following the death of a spouse, the surviving spouse will have entitlement to one-half of the community property (i.e., property that was acquired over the course of the marriage, regardless of which spouse acquired it).

You don't have to get a lawyer to draft your will.

It's perfectly legal to write your own will, and any number of products exist to help you with this, from software programs to will-writing kits to the packet of forms you can pick up at your local drugstore.

A general power of attorney allows the agent to make a wide range of decisions.

This is your best option if you want to maximize the person's freedom to handle your assets and manage your care.

A limited power of attorney restricts the agent's power to particular assets.

Some states' laws provide that a surviving spouse automatically inherits all of the assets whether or not the couple had children together.

In other states, the surviving spouse only inherits some of the estate and surviving children inherit the remainder.

If the deceased hadn't yet retired: Most schemes will pay out a lump sum that is typically two or four times their salary.

If the person who died was under age 75, this lump sum is tax-free.

This type of pension usually also pays a taxable 'survivor's pension' to the deceased's spouse, civil partner or dependent child.
