Setting up a will is one of the most important parts of planning for your death.

Drafting the will yourself is less costly and may put you out about $150 or less.

Depending on your situation, expect to pay anywhere between $300 and $1,000 to hire a lawyer for your will.

The spouse will not be entitled to take the entire estate in only two cases.

They will each take half of what they would otherwise have taken, unless one spouse has issue of the intestate and the other has no issue of the intestate.

A will can be handwritten on a single piece of paper or elaborately typed within multiple pages, depending on the size of the estate and preference of the testator.

It must also be signed and dated by the testator in front of two “disinterested” witnesses, who must also sign.

You don't have to use a solicitor to create an LPA.

The application forms from the Office of the Public Guardian (OPG) contain guidance to help you fill them out.

Alternatively, you can fill them in online and phone the OPG helpline if you have any issues or concerns.

If there is no co-owner on your mortgage, the assets in your estate can be used to pay the outstanding amount of your mortgage.

If there are not enough assets in your estate to cover the remaining balance, your surviving spouse may take over mortgage payments.

When a retired worker dies, the surviving spouse gets an amount equal to the worker's full retirement benefit.

Example: John Smith has a $1,200-a-month retirement benefit.

His wife Jane gets $600 as a 50 percent spousal benefit.

Total family income from Social Security is $1,800 a month.
